Les opportunit\u00e9s commerciales sont nombreuses, parfois lointaines et d\u00e9clenchent des missions de plusieurs jours \u00e0 plusieurs semaines, des d\u00e9tachements ou des expatriations.<\/p>\n<p>Les grandes entreprises sont g\u00e9n\u00e9ralement habitu\u00e9es, organis\u00e9es et savent g\u00e9rer ces situations. En revanche, de nombreuses ETI et PME d\u00e9couvrent les contraintes li\u00e9es \u00e0 la mobilit\u00e9 internationale de ses salari\u00e9s. Le service RH doit s\u2019adapter pour r\u00e9pondre \u00e0 <strong>un environnement juridique, sanitaire et s\u00e9curitaire tr\u00e8s \u00e9volutif.<\/strong> Les risques dans les pays cr\u00e9ent des situations que le service RH doit g\u00e9rer ou faire face \u00e0 tout moment\u00a0: environnements politiques instables, catastrophes naturelles, expositions \u00e0 des maladies, accidents et incidents habituels de voyage.<\/p>\n<p>En 2014, les exemples ont \u00e9t\u00e9 nombreux\u00a0: Pand\u00e9mie Ebola, la crise en Ukraine, les risques politiques au Moyen-Orient.<\/p>\n<p>&nbsp;<\/p>\n<p>De plus, les entreprises ont <strong>un devoir de protection<\/strong> \u00ab\u00a0le Care Duty\u00a0\u00bb vis-\u00e0-vis de leurs salari\u00e9s et fait peser des risques nouveaux sur les entreprises. L\u2019employeur est responsable depuis le d\u00e9part des salari\u00e9s \u00e0 l\u2019\u00e9tranger jusqu\u2019\u00e0 son retour d\u00e9finitif dans son pays d\u2019origine. Il existe une pr\u00e9somption de responsabilit\u00e9 valable 24\/24h, 7\/7j sur les activit\u00e9s professionnelles et personnelles.<\/p>\n<p>Pour rappel, la Directive Europ\u00e9enne concernant la s\u00e9curit\u00e9 et la sant\u00e9 des travailleurs au travail (Directive du conseil 89\/391\/CEE, 1989) impose un Devoir De Protection g\u00e9n\u00e9ral aux employeurs et exige que des mesures sp\u00e9cifiques soient prises. Ceci comprend l\u2019\u00e9laboration d\u2019une politique g\u00e9n\u00e9rale de protection, la suppression des risques connus ou potentiels, la connaissance et l\u2019adaptation de nouvelles technologies s\u00fbres, la formation et la consultation des employ\u00e9s et la surveillance de l\u2019\u00e9tat de sant\u00e9. Les \u00c9tats membres ont transpos\u00e9 cette directive en droit national, elle est donc appliqu\u00e9e de diverses mani\u00e8res par les pays de l\u2019UE.<\/p>\n<p>En France, l\u2019employeur est d\u00e9biteur d\u2019une obligation de s\u00e9curit\u00e9 de r\u00e9sultat \u00e0 l\u2019\u00e9gard de ses salari\u00e9s. Il doit notamment prendre les \u201cmesures n\u00e9cessaires pour assurer la s\u00e9curit\u00e9 et prot\u00e9ger la sant\u00e9 physique et mentale des travailleurs\u201d (Article L 4121 \u2013 1 du Code du Travail). Les pr\u00e9cautions \u00e0 prendre contre les maladies sp\u00e9cifiques connues du pays et les soins particuliers \u00e0 exercer\u201d. Si un employeur ne respecte pas son Devoir De Protection en manquant au respect des r\u00e8gles d\u2019hygi\u00e8ne et de s\u00e9curit\u00e9 relevant du Code du travail et que ce manquement entra\u00eene un d\u00e9c\u00e8s ou un pr\u00e9judice corporel, l\u2019employeur peut \u00e9galement encourir des sanctions p\u00e9nales, y compris des peines d\u2019amende et d\u2019emprisonnement.<\/p>\n<p>Les entreprises doivent pr\u00e9parer leurs missions internationales et mettre en place <strong>un dispositif adapt\u00e9 pour prot\u00e9ger les salari\u00e9s<\/strong> selon les destinations\u00a0:<\/p>\n<ul>\n<li>Couverture Sant\u00e9 internationale, voir <a href=\"https:\/\/ambrelia.com\/quelle-assurance-maladie-internationale-pour-vos-collaborateurs-voici-quelques-conseils-pour-bien-choisir\/\">nos conseils<\/a> \u00e0 ce sujet<\/li>\n<li>Pr\u00e9voyance accidentelle,<\/li>\n<li>Assistance\/Rapatriement,<\/li>\n<li>Autorisations administratives,<\/li>\n<li>Une politique de s\u00e9curit\u00e9,<\/li>\n<li>Un accompagnement en cas de crise (menace, extorsion, kidnapping), voir <a href=\"https:\/\/ambrelia.com\/une-assurance-menaces-et-kidnapping\/\">notre article<\/a><\/li>\n<\/ul>\n<p>Ce nouvel environnement n\u00e9cessite d\u2019anticiper les conditions de mobilit\u00e9 afin de r\u00e9pondre rapidement aux imp\u00e9ratifs op\u00e9rationnels et r\u00e9glementaires. Il faut un service RH tr\u00e8s organis\u00e9, capable de g\u00e9rer des probl\u00e9matiques s\u00e9curitaire et sanitaire tr\u00e8s \u00e9volutives, dans le monde entier.
